Term of Protection

The maximum term of protection of an industrial design in Russia is 25 years from the filing date (5 terms of 5 years each).

What Can Be Registered as an Industrial Design?

An industrial design protects the appearance of a product, including its shape, configuration, ornamentation, and combination of elements.

A single application may include:

• one design, or
• multiple designs (variants), provided that they relate to the same object or form a set of products and share a single design concept

Industrial Design Registration Procedure in Russia

The procedure is examination-based and consists of the following stages:

1. Filing and Formal Examination

After filing, the application undergoes a formal examination within approximately up to 6 months.

The Patent Office verifies compliance with formal requirements, including completeness of documentation and payment of fees, and issues a notification about positive result of the formal examination.

2. Substantive Examination

A request for substantive examination must be filed simultaneously with the application.

During this stage, the examiner assesses compliance with patentability requirements.

3. Grant Decision and Patent Issuance

If the industrial design meets the requirements, a grant decision is issued.

To proceed to registration:

• the grant fee must be paid
• the fee for the first 5-year period must be paid

After payment, the patent is issued and published.

The procedure of the design registration in Russia usually takes from 1 to 1,5 years.

Requirements for Filing an Industrial Design Application

To file an industrial design application in Russia, the following must be provided:

• Applicant’s and author’s names, addresses, and citizenships
• figures (photographs, photocopies or files) with the general view of the design and, if possible, front, top, side, back and bottom views of the design;
• List of essential features of the design (if available)
• Power of Attorney signed and stamped by the applicant
  
  • notarization and legalization are not required
  • may be submitted within 2 months from filing

If priority is claimed:

• a certified copy of the priority document must be provided
• deadline: 3 months from the filing date

Priority deadline (Paris Convention): 6 months from the priority date

Foreign applicants must be represented before the Russian Patent Office by a registered Russian patent attorney.
